Affordable Process Server, herein referred to as “Affordable Process Server”, appreciates the opportunity to serve your court filing, court research, process serving and skip tracing needs (the Services) under the terms and conditions of this Affordable Process Server Services Agreement (the Agreement). Please carefully read and understand the entire contents of this Agreement before using the Affordable Process Server website or Services. Your use of the Affordable Process Server website or of the Affordable Process Server Services will constitute your consent and agreement to be bound by all terms and conditions of this Agreement (as amended from time to time), including, but not limited to, our Privacy Policy, discussed below. If you do not agree with the terms and conditions in this Agreement, we will be unable to provide any services to you.
The information provided on this website does not, and is not intended to, constitute legal advice; instead, all information, content, and materials available on this site are for general informational purposes only. Information on this website may not constitute the most up-to-date legal process service or other information. This website may contain links to other third-party websites. Acceptance of the Affordable Process Server Agreement By placing an order for process service and use of our services constitutes acceptance of these Terms of Use and your agreement to be bound by them, and any Services offered on Affordableprocessserver.com website as described in this Process Server Agreement. You are referred to as the customer described on the Open Account page. If you are not making this Agreement on your own behalf, you represent and warrant that you are legally authorized to enter into the Agreement on behalf of the customer and that your actions will legally bind the customer.
Copyright All content on this website, such as text, terms, graphics, logos, button icons and images, is the property of Affordable Process Server or its content suppliers and protected by United States and international copyright laws. The selection, arrangement, and presentation of all materials on this website (including information in the public domain), and the overall design of this website is the exclusive property of Affordable Process Server and protected by Canada and international copyright laws. Trademarks Any and all graphics, logos, page headers, button icons, scripts and service names used on or in connection with Affordable Process Server and Affordable Process Server.com are trademarks or trade dress of Affordable Process Server. Affordable Process Server’s trademarks and trade dress may not be used in connection with any product or service that is not legally endorsed and authorized by AFFORDABLE Process Server in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Affordable Process Server its products or services or websites. All other trademarks not owned by AFFORDABLE Process Server that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by AFFORDABLE Process Server.
Customer Information and Online Registration Access to some areas and use of some functions of Affordable Process Server Services or Affordableprocessserver.com or other Affordable Process Server websites may require you to register. You agree to: (a) provide accurate, current, and complete information about yourself as prompted by our registration form (including your e-mail address) and (b) to maintain and update your information (including your e-mail address) and keep it accurate, current, and complete. You acknowledge that if any information provided by you is inaccurate, not current or incomplete, Affordable Process Server reserves the right to terminate this Agreement and your use of this website and related services. As part of the registration process, you may be assigned a password or be asked to select a password. You will be responsible for the confidentiality and use of your password and any customer number. YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR PASSWORD AND CUSTOMER NUMBER, AND YOU ARE ENTIRELY RESPONSIBLE FOR ANY AND ALL ACTIVITIES (INCLUDING REQUESTING SERVICES) THAT ARE CONDUCTED THROUGH YOUR ACCOUNT. If for any reason you feel either your account number or your password has been compromised or duplicated, you must immediately contact Affordable Process Server at inquiry@Affordableprocessserver.com or call 778-776-1992 to change your password or account number and to stop any service requested.
Agreement to Conduct Transactions Electronically You agree that all of your transactions with or through Affordable Process Server may, at its option, be conducted electronically. If you do not wish to have these transactions conducted electronically, you should not enter into this Agreement. You agree that Affordable Process Server may determine (from time to time) to provide all or any part of its Services non-electronically, and that those Services will still be governed by this Agreement.
Changes or Amendments Affordable Process Server may at any time, at our sole discretion, update and revise this Agreement by posting an amended Agreement on this website. Any changes that Affordable Process Server makes to this Agreement will be effective immediately upon posting. Please check this page periodically for changes to the Agreement. You will be able to determine if this Agreement has been changed since your previous visit by viewing the “Last Updated” information that appears at the top of this Agreement. Your use of this website, following the posting of any changes, constitutes acceptance of those changes.
Indemnity Any and all clients of Affordable Process Server acknowledge(s) that any information as might be provided or services utilized as a result of investigation, searching or other or services provided by Affordable Process Server will place said purchaser and/or consumer of said services under some risk, and that this risk can result in said purchaser and/or consumer of said services losing capital, suffering liability and/or income and/or tax benefits and/or purchasing power and/or assets. There can be no guarantee that any of Affordable Process Server’s services or reports are admissible as evidence in any court, or completely accurate, or accurate to any degree. Any and all purchasers or consumers of such services on this website agrees to suffer all losses or missed gains from such purchaser and/or consumer’s own funds. Purchaser and/or consumer of said services agrees to hold Affordable Process Server our officers, directors, employees, agents, licensed investigators, assistant investigators, independent contractors, and representatives forever harmless from all claims, liabilities, losses, damages, attorney’s fees, costs and expenses which may arise from any actions, services rendered, or advice taken pursuant to this Agreement, unless rendered or taken in bad faith or as a result of willful misconduct.
Any and all such purchasers and/or consumers of services from or on this website agrees to hold Affordable Process Server, our officers, directors, employees, agents, independent contractors, and representatives forever harmless from all claims, liabilities, losses, damages, attorney’s fees, costs and expenses which may arise from any action we take on behalf of a client, or because of information reported by us. You agree and understand the maximum limit to our liability for any and all services we provide is $100.00.
Liquidated Damages In addition to the foregoing, the Parties mutually agree that any claim made under the Non-Disparagement portion of these Terms and Conditions shall, when disparaging statements have been shown with reasonable certainty to have originated with you or anyone acting on your behalf, carry liquidated damages payable by you to Affordable Process Server, in the sum of One Hundred Thousand Dollars ($100,000.00) in Canadian currency.
In all cases, our liability for any work order accepted, or report delivered, is limited to the fee paid to us for the work performed. This provision is of the essence of this agreement.
Affirmations and Declarations By using the Affordable Process Server website, you represent, affirm, and declare, under penalty of perjury under the laws of the Province of British Columba or the Province or Country in which you are utilizing this website, that: (1) you agree to adhere to the laws and regulations of the jurisdiction with which you are conducting business with Affordable Process Server and that you are subject to civil and criminal penalties should you utilize Affordable Process Server to violate those laws and regulations and (2) you acknowledge that the information provided by Affordable Process Server is derived from local government agency databases and as such may be inaccurate, out of date, contain errors or omissions, or be otherwise incorrect.
Independent Contractors You and Affordable Process Server are independent contractors. Neither you nor Affordable Process Server is an employee, agent, representative, broker, or partner of one another. This Agreement shall not be construed to create an association, joint venture, or partnership between you or Affordable Process Server to impose any partnership obligation or liability upon either party.
Fees and Rates All quoted rates are estimates only and are subject to change without notice. Rates for service of any kind are calculated based upon several factors including, but not limited to: service requested, level of service requested (standard, rush, right now, etc.), the number of individuals, etc. Unlawful detainers (evictions), restraining orders, bank levies and earnings withholding orders (wage garnishments) are charged at a higher rate of service. For service of process, all rates quoted are quoted per proof of service. Affordable Process Server has the sole discretion to determine the fees charged to you for using its web site or Services. Fees for the Affordable Process Server Services may vary by Client, location, service level and or the amount of time spent completing Services. Affordable Process Server reserves the right to change its fee structure at any time without notice. All sales are final. There are no refunds.
Refunds There are absolutely no refunds on cancellation of service after the documents have been assigned to a process server on the service requester’s behalf. This includes but is not limited to: documents being sent into the field for service of process, documents sent into the field for filing, service representatives being sent into the field on behalf of service requester. The no refund policy is strictly enforced and includes all services provided by Affordable Process Server including but not limited to: Standard, Rush, Same Day and “Right Now” service fees, Surveillance Fees, Fronted Fees (witness/material fees, etc.)
ALL SERVICE FEES ARE FINAL AND THERE ARE NO REFUNDS
Guarantee of Delivery No warranty or guarantee of a particular outcome, service of process to the parties on requestor’s behalf. No result or recovery of information is promised or implied by Affordable Process Server, or by the materials presented on this website. Affordable Process Server agrees to work to achieve the goals of any client work or engagement with non confrontational, professional methods, within laws of the jurisdiction in which service of process is requested. Past performance doesn’t indicate future results. Results may vary and are not guaranteed upon service of process.
Charges and Fees for Work Performed Our preferred method of payment is via Email Money Transfer. This helps us keep our prices Affordable. All orders placed for process service, document-related services, deposition-related services, subpoenas, document preparation and or investigative services of any kind or description through this website will regarded by both Parties hereto as firm orders, not subject to cancellation after work has begun, other than as the Parties shall subsequently agree in writing. Affordable Process Server shall not be responsible for failure to file any document that is rejected by court registrar due to errors with respect to incorrect court forms, missing dates, court file number, misses something out in the application form or omits a relevant document, and the filing form is rejected for service of any process provided by the service requestor.
Process Server Document Service Request
Affordable Process Server and it’s agents are not responsible for any errors or omissions on documents provided by the service requestor for service of process or for filing on behalf of the service requestor. Before requesting any service of process, we highly recommend you contact a lawyer or visit the local court registry to ensure that your documents have been properly filed and filled out before assigning a process server to serve your documents. We do not accept any responsibility for any errors, omissions or inaccurate information that appears on your filed documents to be served to any third party. In no event will we be liable for any loss or damage of whatever nature (direct, indirect, consequential, or other) whether arising in contract, tort or otherwise, which may arise as a result of any errors or inaccurate information on the documents you want us to serve, the use of (or inability to use) our service of process, or from your use of (or failure to use) the information on this site, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with any errors or omissions..
Process Service No Legal Advice
We are not lawyers or paralegals. Affordable Process Server will not amend, edit or make corrections on any documents for service or filing on behalf of requestor. The service requestor is solely responsible to ensure that all documents being served to any third party conform with rules, standards or laws of the court documents and forms in your jurisdiction. No service requestor should act or refrain from acting without first seeking legal advice from counsel in the relevant jurisdiction. Only your lawyer or court registry can provide assurances that the information contained on your service or filing documents – and your interpretation of it – is applicable or appropriate to your particular situation. Use of our process service does not create an lawyer-client relationship between the service requestor, agents and their respective employers.
Credit Card Payments All credit card transactions will be subject to approval by management, and carry an extra seven percent (7%) fee to cover bank credit card processing fees. By paying any advance or invoice, The service requestor acknowledges that they will not, under any circumstances, issue or threaten to issue any chargeback’s to Affordable Process Server or to the Client’s credit card and/or form of payment (ie, Stripe, PayPal) for any reason whatsoever related to the Process of Service, once documents have been served or assigned to a process server. In the event of a chargeback, Affordable Process Server reserves its right to report it to the credit bureaus as a delinquent or fraudulent account. The service requestor has reviewed and agreed to these terms and conditions. All sales are final and non-refundable. There is no guarantee of success for any legal document delivery.
Please attempt to confirm the service address before assigning to Affordable Process Server. If the address given to us by our client for the defendant/witness being served is incorrect an additional fee that may equal the original COD amount will be required in advance for service at the additional address or additional parties.
Service Guidelines and Procedures Fees for serving your documents in based on the number of BUSINESS DAYS in which we have to serve them. Service is NOT guaranteed within these days. What is guaranteed is that Affordable Process Server will make documented diligent attempts to serve your documents within these days. Because the defendant/witness may avoid or is not available are circumstances beyond the control of Affordable Process Server.
- The fee for serving your documents in based on the number of BUSINESS DAYS in which we have to serve them and is outlined above. Service is NOT guaranteed within these days. What is guaranteed is that Affordable Process Server will make documented diligent attempts to serve your documents within these days. Because the defendant/witness may avoid or is not available are circumstances beyond the control of Affordable Process Server.
- Affordable Process Server will send an e-mail confirmation to the client when service is made.
- Affordable Process Server will notify the client by e-mail when an update concerning the status of their documents is ready to view. It will be the client’s responsibility to view these updates and, if requested or necessary, respond to Affordable Process Server accordingly.
- Orders not receiving a response from the client when updated may be closed and returned “Non-Served” after five (5) days.
- Affordable Process Server will notify the client by e-mail Affidavit or Proof of Service is available for the client after it has been affirmed by Process Server
- Affordable Process Server will mail the original Commissioned Affidavit of Service to the client by Canada Postal Service first class mail after the commissioned affidavit or proof of service is signed and received from our server. Affordable Process Server will send the affidavit or proof of service to the court of record upon the client’s written request if this service has been requested. Affordable Process Server must have all affidavits or proof or service examined by a notary before it is made available to the client. Affidavit or Proof of Service is NOT guaranteed within a specific time period due to unforeseen circumstances. What is guaranteed is that Affordable Process Server will make diligent attempts to have your affidavit of service or proof of service within fifteen (15) days AFTER the date of service, and cannot guarantee a specific date due to circumstances beyond the control of Affordable Process Server.
- It is the client’s responsibility to make special arrangements for expediting the return of the Affidavit of Service from Affordable Process Server if the filing deadline for the Affidavit of Service is less than fifteen (15) day AFTER the date of service for a nominal additional fee not included in standard service.
- Please take all measures to have the complete name and address of person or entity being served including suite or apartment numbers to assure that additional charges are not incurred.
- Affordable Process Server follows the rules of civil procedure for the jurisdiction that your case is being heard. Any special requirements you or your client may need must be conveyed to AFFORDABLE Process Server, Inc. at the time your order is placed.
- A finance charge of 2.5 % per month may be assessed to all past due balances over 30 days. Accounts turned over to collection will incur and be responsible for the payment of reasonable attorney fees and collection costs.
- Affordable Process Server contracts for services with Process Servers, Constables and Deputies Nationwide. It is our clients’ responsibility to inform Affordable Process Server of any poor experiences with prior service of their documents so the same server is not used by Affordable Process Server. Affordable Process Server continually monitors its contract servers and demands that they follow our strict guidelines.
Taxes which Affordable Process Server may be required to pay or collect under any existing or future law in connection with providing you with the Services shall be charged to your account.
Payment Terms Payments for services are due and payable prior to service being initiated in the form of an Interac E-Mail Money Transfer for all Canadian Residents. In order to have open account terms, an Open Account form must be completed, signed and submitted to Affordable Process Server. If accepted, the customer will be billed for services rendered. If credit is granted to Open Credit Accounts, it is understood and agreed that all invoices will be paid within the standard credit terms (30 days) stated on the invoices. A valid Visa or may be required to use the services of Affordable Process Server, even if applying for open account terms. Continuing credit card billing is available for Credit Card Account customers who do not want open account terms (Out of State customers this is your only option). Because all transactions are conducted electronically, it is understood and agreed that the physical credit card need not be present with Affordable Process Server in order for the charge to the card to be valid and that the validity of such charges will not be challenged. If open account terms are granted, it is understood and agreed that the person, firm or company to whom credit is granted is liable for payment of all invoices. A person, firm or company to whom credit is granted may have a third party pay an invoice directly to Affordable Process Server. However, it is understood and agreed that Affordable Process Server has no relationship with such third parties and has no obligation to collect from them. Payment obligation rests solely with the person, firm or company that submitted the assignment and to whom credit was originally granted and that Affordable Process Server will hold that person, firm or company liable for payment of any invoice submitted to a third party for payment. Affordable Process Server reserves the right to restrict the credit of any customer for any reason.
Privacy Policy Affordable Process Server respects your privacy and we understand the importance of protecting your personal and financial information. By your use of the Affordable Process Server website or Services, you agree to the terms and conditions included in the Affordable Process Server Privacy Policy.
Disclaimer of Warranties and Limitation of Liability You agree that your use of the Affordable Process Server services and information on the web site is at your own and sole risk. All services are provided on an as is and as available basis. Affordable Process Server disclaims all warranties and duties of any kind, express, implied or statutory, including, but not limited to, any implied warranties of merchantability or fitness for a specific purpose, non-infringement or title, duties of workman-like effort, or lack of negligence. Affordable Process Server assumes no responsibility for errors or omissions on its website and is not responsible in any way for the functionality, specifications, or any other aspect of the items posted. Affordable Process Server does not guarantee continuous, uninterrupted or secure access to Affordableprocessserver.com or Affordableprocessserver.com services or that defects in its website will be corrected. You are responsible for implementing sufficient procedures to satisfy your particular requirements for protection of your system and/or accuracy of data, and for maintaining a means of reconstruction of lost data. Without limiting the above, you agree that AFFORDABLE Process Server and its parent corporations, subsidiaries, partners, employees, agents, affiliates, subcontractors, and/or consultants do not make any warranties or undertake any duties regarding, without limitation, the following: (i) Infringement of title or quiet enjoyment; (ii) Functionality, including functionality of search or retrieval software; (iii) Accuracy, completeness, or completion of forms; (iv) Receipt of Affordable by local governments; (v) Appropriateness or propriety of documents pulled for a particular job; (vi) Approval of documents by local governments; (vii) Timeliness of services; (viii) Uninterrupted, secure, error or virus-free service or storage; and (ix) Adequacy of fees paid to local governments.
You agree that your sole remedy for any breach of this Agreement by Affordable Process Server or any of its parent corporations, subsidiaries, partners, employees, agents, contractors, or consultants shall, at the option and sole discretion of Affordable Process Server, be the following: (i) correction of any Service causing you damage; or (ii) refund of the amount you paid for the Service that caused damages incurred by you in reasonable reliance on the Service. You also agree that the damage exclusions and this limitation of liability shall apply even if any remedy of its essential purpose fails.
No Incidental or Consequential Damages To the fullest extent allowed by applicable law, you agree that neither Affordable Process Server nor any of its parent corporations, subsidiaries, partners, employees, agents, affiliates, contractors or consultants will be liable to you, your heirs or assigns, and/or any other person or entity for general, special, incidental, consequential, indirect, or punitive damages of any kind, including, but not limited to, those damages resulting from loss of use, data, sales, goodwill, or profits, whether or not Affordable Process Server has been advised of the possibility, or under any legal or equitable theory of liability, including theories of tort, contract, or otherwise arising out of the use of the Affordable Process Server website or Services.
Further Indemnification You agree to indemnify, defend, protect and hold harmless Affordable Process Server, its parent corporations, subsidiaries, partners, employees, agents, affiliates, contractors, and consultants and their respective directors, officers, employees and agents from and against all losses, claims, and expenses (including attorneys’ fees and costs, incurred by Affordable Process Server with or without suit and whether incurred on appeal or in bankruptcy) arising out of or relating to (i) your breach of any terms of this Agreement, (ii) the determination by a jurisdiction that you have improperly utilized the Services of Affordable Process Server to violate the laws and regulations of the jurisdiction, (iii) your use of the Affordable Process Server Services or your failure to pay all sums due Affordable Process Server or any local government; and (iv) your supplying inaccurate, out of date, errors or omissions, or otherwise incorrect information as well as any action taken by you as a direct or indirect result of the information displayed on the Affordable Process Server web site.
Termination or Cancellation Affordable Process Server reserves the right to terminate your use of the Affordable Process Server website and services, without notice, for any reason or no reason at all. If your use of the Affordable Process Server web site and Services is terminated or cancelled, you agree that neither you nor any other party will hold Affordable Process Server , its parent corporations, subsidiaries, partners, employees, agents, affiliates, contractors, and consultants, liable for any general, special, incidental, consequential, indirect, or punitive damages of any kind, including, but not limited to, those damages resulting from loss of use, data, sales, goodwill, or profits, whether or not Affordable Process Server has been advised of the possibility of such damages, or under any legal or equitable theory of liability, including theories of tort, contract, or otherwise.
Restriction or Cancellation of Service At any time for any reason and without notice to you, we reserve the right to restrict service or we may cancel your service of process. For example, we may restrict your ability to use our services, to use or access the services we provide, and/or if an of the following occurs:
• We believe that the Process Server is at risk, or you have engaged in suspicious, improper, illegal, possible fraudulent, or unauthorized service of process in order to obtain a default against another party without lawful authority;
• A Process of Service, or your use of our process service to serve a legal document, may create an unacceptable risk to the person or corporations being served or to us;
• Anything occurs that causes us to believe you will be unable to make a payment or otherwise not be able to follow the terms and conditions of this Agreement;
• We seek at all material times to protect your or our interests;
• You caused or may cause us to have a financial loss, or professional reputation loss;
• You conduct yourself in a manner way that we find unsatisfactory or contrary to our strictly enforced policies;
• You have made racist, discriminatory, derogatory, false or misleading, or threatening comments toward our employees;
• We reasonably believe that we must do so to protect our employees, customers and/or property from physical harm, harassment, or other abuse, including verbal abuse; and/or If any of the circumstances described in the paragraph above occur, any of the following may happen:
• You may lose the benefit of any process service offer for the service of process
• We may restrict your access to our process services, activity, or restrict the use of any services we make available to you in connection with the Process Services, including service of process or affidavits or proof of service;
• We may require that any service of process that has been effected on your behalf must be paid in full if there is any outstanding Balance for services which have already been rendered, in full. This amount includes any interest you owe and/or
fees that we have not yet charged you.
• We may require the individual who initiated the service of process to pay all of our legal expenses on a solicitor and client basis for attempting to collect what the individual owes us under this Agreement;
• We may apply any other restrictions that protects our interest, and inform our affiliated process service companies to do the same.
Intellectual Property Rights You agree that except as expressly provided that the content and website are protected by intellectual property laws. Affordable Process Server reserves the right to suspend or discontinue all services and online registration for any person or customer that appears are infringing on the property rights of Affordable Process Server or any of its subsidiaries.
Comments and Suggestions You agree that any comments or suggestions that you provide to Affordable Process Server regarding the Affordable Process Server Services, including, without limitation, feedback, suggestions or ideas in response to any customer survey shall be deemed, and shall remain, the property of Affordable Process Server. None of the Comments shall be subject to any obligation of confidence on the part of Affordable Process Server and Affordable Process Server shall not be liable for any use or disclosure of any Comments. Without limitation of the foregoing, Affordable Process Server shall exclusively own all rights to the Comments of every kind and nature and shall be entitled to unrestricted use of the Comments for any purpose, commercial or otherwise, without compensation to the provider of the Comments.
Governing Law This Agreement shall be governed by the laws of the Province of British Columbia without regard to its conflict of law provisions. You and Affordable Process Server agree to submit to the personal and exclusive jurisdiction of the courts located within the Province of British Columbia.
Force Majeure Affordable Process Server shall not be responsible for interruptions, delays or failure in performance resulting from causes beyond its reasonable control. Such acts shall include but not limited to acts of God, war, and riot, acts of terrorism, labor stoppages, governmental actions, fires, floods, and earthquakes.
Third Party Rights The provisions in this Agreement are for the sole benefit of you and Affordable Process Server and shall not inure to the benefit of any other person either as a third party beneficiary or otherwise.
General Provisions Neither this Agreement nor any part or portion may be assigned or otherwise transferred by the customer without Affordable Process Server’s prior written consent. Should any provision of this Agreement be held to be void, invalid, unenforceable or illegal by a court, the validity and enforceability of the other provisions will not be affected thereby. Failure of any party to enforce any provision of this Agreement will not constitute or be construed as a waiver of such provision or of the right to enforce such provision. The headings and captions contained in this Agreement are inserted for convenience only and do not constitute a part of this Agreement. The failure of either party to insist upon or enforce strict performance by the other party of any provision of this Agreement or to exercise any right under this Agreement shall not be construed as a waiver of the right of such party to assert or rely upon such provision or right in that or any other instance.
Effect of Agreement This Agreement (which includes all current Amendments, your Open Account form, Application for Credit, the disclosures provided by Affordable Process Server and the consents provided by you on the Affordable Process Server website, embodies the entire agreement between you and Affordable Process Server. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the intentions of the parties as reflected in that provision and the allocation of risks set forth in this Agreement, and agree that the remaining provisions of this Agreement shall remain in full force and effect.
Acknowledgement You certify that you have read and understand this Agreement and state that you agree to be bound by the terms and conditions contained in this Agreement by using the Services of Affordable Process Server and by signing the COD Request, Acknowledgement & Procedures. You agree to comply with all cities, provinces and federal laws and ordinances relating to the Affordable Process Server services.
